My wife refuses to return and I wish to sue her for Damages

Dear Sir / Madam

My wife had left me approx 5+ years ago. After many an invitation she refuses to return to my house (her matrimonial house. Even now I am ready to take her back, should she come. But my wife refuses to join me permanently.

Now I understand the real meaning of her *not* returning - she is in a plum job earing approx Rs. 10 Lakhs per annum

I have lost 6+ years of matrimony + love and affection of my daughter and my wife has also filed false complaints against me. I wish to sue for divorce and also damages - for separation, loss of marital life, loss of parental affection etc.

- How much can I get as damages ?

- I have a 6+ year old daughter (now living with my wife). Can I get custody of the daughter ?

- What proof should I submit to get divorce + damages

Please help

You can surely file a suit or divorce in a cout of competent jurisdiction.In the divorce suit, you can also pray for child custody; there is every chance that you will get the divorce as well as custody.

As regards Damages, you may have to file seperate proceedings; ideally aftr you get the divorce.
