Legal Question in Family Law in India
W.r.t. my previous question about my friend asked y'day, you suggested us that we ask the husband's side to deposit pay order in the court which the court will give to us after divorce.
Thankyou for the nice suggestion. We communicated this to the boys side but they flatly refused for this. We suggested them to give a cheque with bankers garauntee but they refused to this also. Instead they started shouting and talking badly to us.
I dont understand what is the big deal about returning the money we gave to them. And if they want to return money in white by cheque then why not a draft. Whats the difference? Just some draft making charges, consider my friend's husband is earning in USD!! If they are good people they should be happy that we are not asking for alimony.
As we had suspected, they had the plan to bounce cheque. The language used in the draft of divorce sent by them had alerted us as it was very clever and manipulative.
These people are very greedy and we know for a fact that they can do anything for money or to not part with money. My friends family actually are stuck with the wrong kind of people as one of their relative misguided us about these people before marriage. That man married my friend only for money and once he knew he had fully exploited her father he left my friend. In terms of respect in the society they are not our class and have a bad reputation with most of their close relatives also. The point being that our experience with them and their reputation in their relatives and zero social circle (family friends) tell us that they are not at all trust worthy.
What do you suggest we do now.

from your post, it is pretty clear that the people you dealing with are crooked. they do not intend to pay the alimony otherwise they should have not refused the payment through pay order or bank draft. in such a situation, i suggest you to meet a matrimonial lawyer of your area and resort to legal remedies available to the girl under domestic violence act, Hindu Marriage Act and other maintenance laws.
As advised before, instead of negotiating, you should file a criminal complaint seeking their prosecution.
