Legal Question in Family Law in India

My younger brother's second wife had filed a false case under section IPC 376/406/420/506/120B/34 against him & all the family members including me. Both of them were married 18 months back second time. She had a daughter of 6 years old. They both live together for about 3 months or so. They all were living at Delhi in my house. I am living in CG with my family as I am working with central govt. PSU. She is alive & living with her parents in delhi. After 2 months of marriage, they both were living in a rented house. After about 1 month, she went back to her parents and filed the first case of domestic violence & maintenance charges. She was indulged in smoking, drinking & at many occasions found absent from the house.

In the first cae which is already in progression in which my younger brother has been ordered to give Rs. 2000/- pm as maintenance charges to her.

More facts about the lady is that she was pregnant at the time of their marriage as about one month of marriage, she had been aborted. Also, it was her 3rd marriage recently we came to know.

During her stay with my parents in my house, when she came to know that there is no property/house belongs to my younger brother, she was totally changed & started doing abnormal things & shouting ill words to my parents & all my family members. As the house belongs to me, she has knowingly included my name in that case.

Kindly advice me how to sort out the things as all the allegations are false.

At present, the local police is enquiring my parents, younger brother & all the family members under section IPC 156(3).

An opinion may not help you at this stage. You need to engage a counsel for pursuing your legal remedies in the local courts. You may be required to seek anticipatory bail.

Participate in the Police enquiry along with lawyer and prove that you were all innocent and the complainant is at fault actually.
