Legal Question in Civil Litigation in India

myself 51 years old, suffering from acute diabetes, high blood pressure, hypertension etc. arising from joint family disputes, and am under doctor care (total 4 medicines for blood pressure and 6 medicines for sugar) in all 10 medicines. Not bed rest, but avoid all tensios, if want to continue living. I am from Ahmedabad and have to appear for city civil court in Kolkata for my pending CROSS. Under medical advise, i am not to travel such long distance. I have sumnitted doctor's certificate on file and have also applied for Comissioner at ahmedabad, to record my SAY.

I have been intimated about some supreme court judgement favouring commissioner, in such type of cases. Can i be favoured with such detail, to press for commissioner, else i may have to let go my Kolkata civil suit rights., kindly assist.

The appointment of commission may be in the discretion of the court; a commissioner may possibly be appointed if your lawyer is successful to persuade the court.
