Legal Question in Civil Litigation in India
There is agreement of constraction and renovation for a sum of 5.50 thousand rupees out of which 4.85 has already been taken by the contractor and stop the work.He has not done more then 3 lakh rupees work till date and despite of fact demanding full payment ortherwise threaten to stop the work . Agreement says if any disputes arises between the parties than that will be solved out by arbitration only. what could have been the best way to solve out the matter in minimum span of time and under which provision/ act. And can we set aside the arbitration clause from the agreement .

u can file civil case but then he can file arbitration application and then the case will be referred to arbitration. so best method is that u should given him an arbitration notice and you have to spend some amount. if he is just harassing then he will give in.
