Legal Question in Civil Litigation in India
I and my three brothers purchased a land in the year 1970 by joint funds and the registration was done in the name of my elder brother. and in the year 1972 constructed a house on the same land, construction permission was issued on same my elder brother. since then to till date my elder brother and his family occupied the house. in the year 1993 , my elder brother passed away. in the the year 1976 a partition deed was singed between we four brothers on plain paper, stating that the property is divided among we four. after the death of my elder brother we asked my brothers widow and children to give us our share. to which they denied. my question is can we claim our share in court, how strong is our chance.

you may claim your share by filing a suit for partition as the property was purchased by both the brothers jointly.
