Legal Question in Civil Litigation in India
This is a case of one of my family members. The person has just retired in oct 2009 from the post of a health officer but has been issued 16 c notice by the state government(DM)(encouraged by the one of the person's superior in his department) which will stall the award of his pension till the matter is settled. The charges made are unjust and we have filed a case in the high court of the state The status is civil writs. The hearing is yet to take place. I want to know how long the case should take to get solved and is there a procedure to expedite the judgement. The person mentioned here is a very honest man, has done no wrong and was asked to execute a task which involved accepting illegal commission from certain parties to which he refused thereby removing all possibility of his superior receiving those commissions and hence has been falsely implicated by them. This will cause severe economic and mental pain to the person concerned as his pension is his only source of income. Kindly advise!
