If a court recorded evidence beyond the pleadings without any objection which is not a part of pleading at the time of institution of suit, is court bound to grant releif if amendment of plaint is rejected by court, please refer law point / judgements

any evidence that is relevant to fact in issue can be recorded even if it is beyond pleadings. it is upto the court to appreciate the evidence at the time of final judgment.
