Legal Question in Civil Litigation in India
Dear experts,
there is a 3 feet shared drain running between my house and my neighbor's house for the past 70 (seventy) years.but now my neighbor occupied the drain area by builting a small store room.Without any documents he says that the particular drain area belongs to him.Actually there are no documents for all the houses in my village.this problem was occuring for the past 5 years.
since he is a former dmk political candidate he didnt mind about the 2 eviction order issued by panchayat counsil.Since he got jealous on my growth, he does so.I wish to see the drain run in its way.what should i do? please guide me.Thank you

You send notice to demolish the store room and if he is not willing to do so, approach the court for mandatory injunction and to demolish the store room constructed on the common drain area.
