Legal Question in Civil Litigation in India

dear sir if seller file affidavit in L&DO without show all legal heir name but L&DO on the ground of registered will and concealed the name of other non beneficiary legal heir's according the register will mutate and get freehold in name of beneficiary legal heir's and beneficiary legal heir's are sold the property to us but other legal heir file partition suit on them and make us party with them and court order for status quo , now we file criminal complaint against seller for cheating because they could not show other legal heir's name to us and L&DO and file 156(3) if the judge could not order for FIR 420 and other then what can i do?

if the judge has not ordered registration of FIR, has he ordered to lead pre summoning evidence.
