Legal Question in Civil Litigation in India

Dear Sir,

We have one charitable trust registered under Indian Trust Act, 1882.

We have been given the task of plantation by one company and for that under the agreement we needed to pay some wage assistance to farmers for plantation.

We did the same and documents etc submitted to them in December 2008. Now in April 2011 the company claims that the farmers have not done plantation at all.

my querry goes as below:

1. How far trustee are indemnified under the trust act.

2. Can company claim this after elapse of 2 planting season.

3. Are farmers not responsibile and should not be made party under the case when they have specifically mentioned that if they do not do plantation, they will refund the entire money.

4. Can company claim Loss of profit, goodwill etc?.
