Legal Question in Civil Litigation in India
Decree was passed in partition suit in year 1935.alongwith shares, share was given in well. one party kown saying that other party is obstructing to take water of his share from well........whether party can file suit for perpetual injunction on basis of partition decree , or go for executuion as there is no limitation for partition decree. that party has no prima facie documents to show that he actually take water from well since decree..
