Legal Question in Civil Litigation in India
I am facing a problem of shifting to my new job. I have given my resignation on 1st June 2010. As per the employment terms, on resignation or termination, there would be a notice period of 1 month or pro rata notice pay on the shortfall in number of days from either side. I had resigned on 1st of June and was to be relieved on 30th June. Now my new employers are asking for the acceptance of my resignation which I have not received yet. My appointment letter did not specify any clause for acceptance of resignation. Should I be treated as deemed released as per the Law of Implied Acceptance? What should be my approach with my new employers?
