Legal Question in Civil Litigation in India

I have filed civil suit in ahmedabad city civil court (claim for dues payable by the company) against a private limited company, which is registered in mumbai. The deft.company has taken objection for Jurisdiction, stating only company law board in mumbai has jurisdiction. I cannot go to mumbai and move CLB. Kindly guide how can I proceed in ahmedabad city civil court ?

the jurisdiction is decided upon the basis of cause of action. your question has not given facts about cause of your action. However, the stand of the company is in correct. The judgment of Patel Roadway passed by supreme court is in your favour. the jurisdiction is of the place where cause of action ( be it may in part) arose and not where the registered office is.
