Legal Question in Civil Litigation in India

hallo sir,

my name is harish

1. i gave 5lakhs to a person 5 years back and excuted and an unregistered deed with a condition if he could not pay the amount with interest within 3 years i will have the right to enjoy that property and to sell.

2 recently i came to know that the said property what was mortaged to me was seized by cb cid . the property documents was with me only

3 the cb cid is going to conduct anction the said property in future

what can i do sir

my doubts is wether my unregestered deed is valid or not

can i get the property of that mortaged

please give the solution to proceed

u should file a civil suit and seek stay against the sale of proeprty against cb cid.

since you have the original document, the property is in the form of equitable mortgage which is legal. you can file a suit and get the stay for auction of the property
