Legal Question in Civil Litigation in India
Can a KARTA of HUF sell a property without the consent of all members of HUF ? If already sold, what action the member (who was not consulte) can take. The property was partitioned and the same was declared in IT Returns.

No a Karta of an HUF cannot sell property without the consent of all members. if already sold the family member who was not consulted, and if not satisfied by the answer and convinced that the sale of property is not for the benefit of the HUF can file a case in the appropriate court challenging the sale of that portion of the property and get the sale declared illegal & null & void and not binding on the HUF. thks shantarao associates, 09920563943
NO THE KARTA CONN'T DO THE SAME BUT FOR THE FAMILY PURPOSE HE CAN DO IT
no. unless the Huf is under urgent necessity and the property is sold for benefit of HUF.
