Legal Question in Civil Litigation in India

Kindly advice me on the following:

What is the position of a nominee in a flat, where the unmarried owner expired.

2.Three nominee are named, the first being his mother, who expired earlier.

3. The deceased owner has three heirs, two brothers and a sister.

4.One of the brothers is named as a nominee along with his son. This brother is claiming that the flat must be transfered to him, leaving aside the other heirs.

5.A will is made but this too has no proper signature and they are refusing to have the same will Probated.

What is the position of the nominee and the other heirs.

Kindly note that there no witnesses have signed on this nomination paper

The nomination paper does not have a number.
