Legal Question in Civil Litigation in India

Hello Legal Advisors,

To file a civil case in High Court, challenging the property Sale deed executed about 2 years back worth of 32 lakhs at the time of registration,

- What could be the court fee that I should pay if I file the case now (March 2010).

- Is there any fee slab based on the worth of the property. Please give clarity.

- If I win the case, can I claim the litigation expenses from the other party.

The case may be filed in High Court only if you have a decision from lower courts. otherwise, for the first time, the case has to be filed in trial court.

the court may be payable ad volarem depending upon Rules of your State.

Even if you win, it is not necessary you may get litigation expenses from the other party; that issue is decided by the court at the time of final judgement.

Dear Sir,

Your telling that the property sold two years ago (2 years) for thirty two lakhs (Rs.32 Lakhs) in consideration of sale proceeds, then with in the three years (3 years) time period limitation accord to the limitation act 1963 you have to first challenge this in the respective trial court. For the Court fee charable you can look at the court fee manual of your state, Ok ?
