it would depend upon what relief you are looking for and what is the cause of action involved. The litigation would start with the cause of action. Cause of action is bundle of facts.

when any of your civil rights are infringed, you file a civil action based upon the injury or damage done to you or to stop the further damage. in case of criminal cases, it is the state who is responsible for the litigation and trial. you may need to approach the police for any offense affecting you.
