Legal Question in Civil Litigation in India
The loan was taken by A and B was guarantor. There is a valid acknowledgement of debt signed by A. Can B take a stand that in the absence of an AOD signed by him Bank cannot proceed against him ? Is there any Supreme Court decision on the issue?
