Legal Question in Civil Litigation in India

My maternal uncle ,unmarried,

died intestate. can we as children claim an entitlement

through my mother who predeceased him under class2 entry 2 in this regard .it is not selfearned property because he never worked during his lifetime but we have no papers to show that it was bought in lieu of ancestral property after migration from pakistan.

you can claim only in case class 1 heirs are not there.
