Neighbour creating trouble

We are staying in our own house.Our neighbours who built their house before we did,had encroached.We let it go at that time since they begged pardon.

Now their kids are causing trouble,they jump into our house,get their freinds from other places,Play cricket behind their house and hit the ball on our room wall it is as though they are hitting on our head if we are in our room,which disturbs our studies.several complaints to their parents are in vain.

now if we tell the kids to go outside and play their parents come and tell indirectly tell that they have influence,thier relative is a circle inspector and so on..

it is disturbing to stay peacefull at home.

we are not so very well versed to use any influence or money for this matter.

please advice in the matter above.we are in big dilema in this regard.Daily we have to face new problems because of them

Hello,

I have gone through your problem and advice you to lodge a complaint before nearest police station and if you see that police do not take any action against those kids or persons then you collect the free copy of the F.I.R from the police station and then file a complain case against them before the court of Magistrate Ist class of your locality.In your letter it reveals that some portions of your area also be encroached by them.Again i advise you to consult with a civil Advocate of your locality for filing an eviction suit against them.Any query in this regard is highly solicited.I am with you to show you the right path.

you have not mentioned the time when your land was encroached. you can recover the encroached portion if it has not been more than 12 years, besides you can also seek injunction by filling a suit in civil court against them restraining them from doing the acts complained by you.You can also lodge police report for their prosecution for your harrasment.

It is better that you get your house fenced, so that kids cannot get in to the house. You cannot send kids to jail for playing or creating nuisance. But you are entitled to file suit in court to curb such sort of nuisance.

Kindly let me know about encroachment, have they have encroachment in your land or govt. land.

if they have done any encroachment then u can make complaints to the municipal corporation.

if they are creating nuisance you can file suit for stopping nuisance.

nothing else looks possible in the light of these given facts

You may approach court by way of injunction suit against your neighbourand for your portion of your property you have to file suit for possession.Take consultation of a lawyer with all details.
