ownership of land

Suppose i am the owner of a flat and the owner of the land on which the flat is situated is someone else.Due to earthquake all the flats including mine are destroyed.The land owner is now entering into an agreement with another person to raise flats there.He has put up a sign board ''tresspassers will be prosecuted''. we have gone to the court and asked for interim injunction that the land owner shall not hand over posession or alienate the land to any other person.

The flats were constructed under the provisions of Maharashtra ownership Flats Act.

How much chances of success do we have. And what other kind of relief can we opt for against the land owner.

Can the law of adverse posession or Blance of convenience help us.What other points can we raise in are favour.
