Legal Question in Civil Litigation in India
i have purchased a car nov 2005 , loan aggreement with ICICI bank and same was stolen in Dec 2005,.I lodged an Fir and in 2006 an untrace report has been filed by police.andI informed ICICI Lombard in this regard through all original documents and deposited there NO demand notice was ever sent by both of the complany. Now in 2010 Icici Bank filed a suit for recovery agaist me . I have NOT taken claim .ICICIbank foreslosed my account in 2007?Plz tell me under order7 rule11 can plaint be dismissed , if not what remedy I can avail.
