We r pending with suit of partition in highcourt delhi.we have mutually agreed on terms with our selves and had decided to end littigation with settlement deed as degree from court. My question is1) what type of taxes do we have to pay to the court when settlement degree is passes im the court? 2)what if we sit in mediation than is there any kind of tax liable to be paid to the court ? 3) and if in any case tax has to be paid than who is liable to pay this tax plaintiff or defendant?

sir:
you surely are entitled to return of court fee paid at the time of filing of suit for partition. but stamp duty is payable by all, plaintiff and defendant on the quantum of share received by each.
