Legal Question in Civil Litigation in India

R/sir,

I was a member of an association of person(A.O.P.).I dissociated from that a.o.p. and as per dissociation agreemnet made, the remaining members took over all assets and liabilites of that a.o.p.

Now,a depositor of that a.o.p.who had deposited some amount when I was a member asking for

his money back making me a party in this regard.

Am I responsible to pay him .I have the copy of dissociation.I had also imformed him by U.P.C.

at the time of dissociation.

kindly suggest me.

The matter is purely contractual and an appropriate opinion may be possible after examining all the documents. The depositor may not be a party to the "dissociation" agreement and therefore he may have a valid claim against all persons who were members at the relevant time. However, if he succeeds in claiming his deposit amount from you, you may have a remedy against other members in terms of your agreement.
