Legal Question in Civil Litigation in India

S & Co. a firm of printers, agree to print 1,000 of a book for B & Co., a firm of publishers. After printing the book and delivering all copies to B & Co., S & Co. discovered for the first time that parts of the books are libelous. B & Co. are now refusing to pay the contract price. S& Co. files a suit for recovery of price.

S & co entitled to recovery as they are mere printers and have no authorship.

in case the libel was committed by S & Co without the express consent of B, S cannot recover the price rather B can sue S in case the copies are circulated.
