Legal Question in Civil Litigation in India
Sir, my grand mother is allotted a property by DDA. Her daughter in law sold her property by making some forged documents like Will Spa, Agreement to sell etc. The person who purchase this property constructed a super structure there upon. my grand mother filed a suit for possession before trial court. the alleged documents were sent for comparison of thumb impressions from CFSL and found different patterns from my grand mother. and court decreed the suit in her/my favur.
The person who purchased it from her daughter in law now in appeal before Delhi High Court and claiming the ownership of property as a bonafide purchaser. can court ignore the CFSL report of thumb impressions and revert the judgement passed by trial court in her/my favur.

in this situation, when the property was sold on GPA, will etc....the buyer may not be able to sustain the plea that he is a bonafide purchaser. once the will needs to be executed by the grandmother, and her thumb impressions are not matching and she was the alleged seller, the conspiracy between the daughter in law and the new purchaser may be established. you have a strong case.
