Legal Question in Civil Litigation in India

Sir,

I am practicing Advocate. one of my client belonging schedule tribe and is an illiterate and innocence person. Two years back one of his friend of my client offered exchanging their lands. My client yielded to the pressure and got the lands exchanging and register. One year after, my client elders came to know about exchanging the lands and scolded my client and his friend got the Regd. Document returned. Now my client wanted to get the cancel in the Registrar office and request his friend to come to register office. But his friend is deliberately a wading and not coming to the registrar office. Now what remedy is there before my client to what case should be filed in the court of law?

Issue a legal notice on behalf of your client to his friend asking him to come forward for executing the cancellation of registered document in the concerned sub registrar office within a period of 15 days, and threatening in the legal notice that if he fails to do so, you will proceed to file a case against your clients friend for cancellation of the document in the appropriate court and that he will be responsible for the costs and consequences thereof. If he does not come even after 15 days, you will have to file a case against your client"s friend for cancellation of the agreement and obtain an order from the court for cancelling the registered document with directions to the concerned sub registrar office for recording the cancellation in their records. thks shantarao associates 09920563943 011 26173648
