we had sold our flat in pune it was decided that the deal should be closed within eight months as per agreement to sale now eight months has already crossed the the party is not ready to do cancel deed

Your rights will be governed by the terms and conditions of agreement. The party failing to honor its committment will be liable for damages for breach of contract.
Dear Sir,
As of parties to contract, buyer of your flat may institute the suit for specific performance of contract through the Transfer of Property Act 1882 in court of law at your jurisdiction by claiming damages or compensation with terms & condition of contract agreed upon by you and him, because of such stipulation of time in the mere contract, or such abrupt cancellation of that contract.
