Legal Question in Civil Litigation in India

i'm a student from meerut.i came to pune and ordered a flat which worth 25 lacs giving 1 lac rupees as token amount and payed rest of the amount later both by cheque.when i went to the flat i found that a person is alraedy residing.when i went to the builder he told me that he will give me another flat which is under construction after 6 months.please tell me the charges i can file against him.is this come under contract law?give me an explained answer about laws applicable and how to apply?

in this situation, you can approach the consumer court and in case you have the documents pertaining to the flat possessed by someone else, the builder is also exposed to criminal liabilities. you may contact my associate lawyer in pune if you like.
