Suit for the Property
I got money from my father by selling his property.
I have paid a cheque for Rs.47,000 in my ex-wife's father's name to buy the plot.
My ex-wife has forced me to buy the plot in her name as she convinced me that it is easier for her to get a VISA to go to US for higher studies. I have taken Housing loans from HDFC & LICHF by inflating her income to Rs.7,500/- per month although she is not earning even Rs.1200/ per month. In 1995 Dec. she ran away with all documents of the house with my children. The above lady tried to sell the property by giving ads,we have filed the suit.We filed the house suit for only 50% of partition of property as advised by the Advocate.He has asked for adjournment even when there is no representation from the opposite side.Failed to give petition to the Judge as promised in the court. Judge dismissed the case. Opposite party sold the property within a month. EX-wife was arrested many times on IPC 406&420.She was in Saidapet Sub-jail for more than 30 days as she had cheated many by borrowing money for 3 Crores. I divorced that lady on mutual consent in 2004.My children came to me in Jan '2006. Kindly Advise me the course of action / Strategy to be followed to get my property back.

I believe your wife has sold the property. In that case, you may not be able to recover the property. However, you can sue her for recovery of sale consideration.

You have already gone to the court in respect of the same property. It may be better to follow the advice of your local counsel who conducted the case since he may be fully aware of all the facts.
