Legal Question in Civil Litigation in India

Hi Team,

my grand father registered a house to my mother and my grand father had it from his dad my grand father expired recently, now problem is with my uncle he claims that it is my property and has a right as grand son he ask us to leave that house we have been staying in that address for past 10yrs we got voter id, passport, pan card with that address and more over he get registered the same house by forgery. we already filed a case in court 3yrs ago with my grand father. his main claim is as a grand son this property will be inherited to him automatically. we would like to know how genuine his claim is,does he have any chance to ask us to leave . what are the chances do we have and actions need to be taken to control him. please give me a suggestion

You do not have to leave the house. However unless the cases filed by you and your uncle and registered deeds ti your mother and your uncle registered deed are studied, a final opinion/ legal course of action cannot be given. So please contact with all documents. [email protected]

Dear Sir / Ma'am,

Devolution of Interests lies on every member heirs of the joint family (if un-partitioned), so make it clear whether this is a self-acquired property, or joint family property, or with any testamentary succession (will wise succession) of the property ? As told, that you've sued at Court of Law for cancellation, or declaration,or partition is a question ?
