Legal Question in Civil Litigation in India

Two year back, one person rented office space from me & paid the first month rent by check immediate to secure the space. He wanted some changes in the setup that I did promptly. He didnt come back to sign the agreement nor came to take possession. His initial feeble response was he is in disagreement with his partners and partnership is broken. We almost forgot the case then after 5-6 months he came back and started asking his money back. He complained to police, we gave our statement and they were satisfied. Now he has filed a 420 case against me. Kindly advice the action that I should take. He is claiming that he paid the money but when he came to take possession, I didnt give him the possession, abused him, didnt sign agreement & refuse to refund money:(.

Its unfortunate. Bring all the facts to the knowledge of the police/Investigating officer and the concerned Court. But you may have to return his money, as you have not rendered anything to him in return. He has no liability to pay the said amount to you. At the best, you can deduct the expenses incurred in carrying out the changes as per his desire.
