Legal Question in Immigration Law in India
214(b) INS is contrary to ethics of democracy. There must be a way to appeal for a change of this in US Congress/Sanate/Supreme Court. When even war prisoners have rights as in Gautanamo case how come rejection of visa under 214(b) - (intent to immigrate) is not questioned.

challenge the impugned law and take appropriate relief

Who are you ? are you an Indian ? Refusal under Sec 214 (b) means that you are a Potential Immigrant and your chances of coming back to your roots/ country are negligible . How many times your visa has been refused ?
