Legal Question in Immigration Law in India
I am the Beneficiary now residing at India. My CR1 visa petition approved. got Birth Certificate and realized that my US spouse filed the petition with wrong DOB. I am getting oppertunity to get B1-B2 visa. Do i have to withdraw the Cr1 petition to get the B1-B2 visa? Can I refile after coming to US with B1-B2 visa? Need advise.

CR 1 visa stands for Conditional Residence which means conditional green card filed by an American Citizen spouse. If you are getting B-1 and B-2 visa (which i would think otherwise ) despite your petition for CR 1 is pending , then go ahead without withdrawing any petition for CR 1
