Since you are divorced, you must have a copy of divorce decree from the court. In your affidavit for passport for your daughter you will narrate the fact of divorce supported with the copy of decree granted by the court, that alone will suffice and you do not need the help of her father for issuance of passport. it can be issued on your signature and an affidavit from you alone.
what is this? How many times have you submitted your question?
you may do as guided by my Ld. friend Mr. Arya. the passport authorities would not object to issuance of passport unless your ex husband has any objection to the same and the objection is conveyed to the authorities in writing or there is no pendency of any sort of litigation where your husband has alleged that you would take the daughter out of country without his consent. is the natural husband in touch with you. if he is, better seek an NOC from him for future purposes.
You may seek "exclusive custody" of the child from appropriate court.
