Doubt about immigration
Is it possible for a US citizen to take her spouse who has overstayed in US for about a year from India to US ?

Even if it may be legally possible, it should be avoided because after the person has overstayed in USA, he become a 'suspect' in the eyes of the BICS. Therefore, if the person overstaying is already in USA, he should not come to India for marriage; rather he should wait for the marriage in USA, get his documents prepared; and may travel to India after his US stay is legalised.
