Legal Question in Immigration Law in India

Doubt about US immigration law

Sir,

I am--name removed--from India. I'm a registered nurse and has completed CGFNS, IELTS and NCLEX-RN exams and my greencard processing is on the final stage.

In this context, could you please clarify some important doubts, given below.

A marriage proposal is in consideration for me now.The proposed boy was working in a US ship as Chef . After completing his contract of 6 months in ship, he moved to Newyork and has been staying in US for the last 4-5 months on C1B visa, which got expired in June 2008.So now he is staying in US on illegal status.

1.If I marry him,is it possible for me to take him along with me on my greencard to US, since he has been on illegal status there ?

2. If not possible, could you please tell me the other options? Is it possible for him to get any visa other than immigrant visa ? (visit visa or any other)

3. If possible, is there any minimum time period after which he can apply for a US visa ?

3. When he come back to India after his stay in US on illegal status, will the authorities stamp his passport ( or any other documents) with a 'no entry' so that he won't be able to re-enter into US in future?

Expecting your valuable reply,

Sincere regards,

Re: Doubt about US immigration law

Your apprehensions about his 'no entry' are not entirely wrong, if he returns to India after having 'over stayed' in USA. Therefore, it is better that he waits for you in USA and you marry him after reaching there. You can sponsor his green card after marriage.
