Legal Question in Immigration Law in India
Expired C1B visa
Is it possible for someone who has got an expired C1B visa for 4-5 months but who is still staying in USA to get any valid legal US visa during his stay there? He is working as a chef in a restaurant there. If possible, could you please tell me the type of visa that he can get? If he comes back to India, will he be able to go back to US as spouse of a greencard holder or is he ineligible due to his 'overstay' in US?

Once he return to India after having 'over stayed' in USA, the chances of his return to USA are bleak.
However, his stay in USA may be legalised after his marriage with a greencard holder.
