Fiance visa denied

My brother in law was in India trying to bring his fiance to US. at the last minute, they denied simply because of typin error. one of the document has intend to wed as soon as they arriv in US buone of the paper says wedding. with that reason his petition was denied. he went to India for the second time leaving his job and aging mother. can you please tell what steps to appeal and your recommendation. they are in new Delhi right and struck and shocked.

Hi There,

The denial letter should tell you how to appeal and normally there will be a 33 day timelimit. From I-290 should be completed with appropriate filing fees. The appeal form is normally sent to the office the denial came from which is then forwarded to the Administrative Appeals Office in Washington DC. Please ask your brother to carefully read the denial letter for instructions.

Having said that, appeals normally take a long time to be adjudicated. You might find that it will be quicker applying afresh for a fiancee visa or your brother can get married in India and apply for a spousal visa.
