Overstay and visa availability
Is it possible for someone who has been overstaying in US for a year on expired C1B visa to get any legal visa before coming back to India? Professionally he is a chef.Since he is a chef,is there any possibility for him to get an H3 visa or any legal visa related to his job ? If he get a legal visa there during his overstay and if he comes back to India after getting his visa, will he be able to go back to USA later ?

Once his visa is legalized/regularized in USA, the stigma of 'over stay' in washed; and then he may travel free to and from USA.
