self petiton

i got married in 2006 to a green card holder . im in india .can i file for immigration under self petition for me and my son whos 4 months old .

my husband had abandoned me ..not divorced me as yet.

please let me know asap. and how to go abt it ? thanks

You will need your husband to sponsor for your immigration petition. Please write complete facts of your case, more particularly reply to the following questions :

Where was your son born?

When the child is 4 months old only, when did your husband abandon you ?

How you reach to the conclusion that your husband has abandoned you?

Has he filed for divorce or notified his intention of separation?

Some of your answers may constitute 'domestic violence' against you by your husband leaving you free to resort to appropriate remedies.

You are entitled to pursue your remedies against your husband in India as also in USA. If you need to travel to USA to pursue your remedies against your husband, you may apply for appropriate visa.
