double insurance

i met with a major road accident while travelling in a taxi.

i have got medical insurance,which will pay medical bills of the hospital.

however can i file a case against taxi owner or driver.

Under Indian Law, you can file a claim under Motor Vehicles Act against the owner of the Vehicle seeking compensation

You can also claim against the driver, owner and the insurance company of the taxi driver under the provisions of the Motor vehicles Act, 1988. The amount paid to you for medical bills by the medical insurance will a different issue whic will be a totally differnt Issue. The bills which will be reimbursed by the medical policy cannot be reclaimed in the compensation suit under the provisions of MV Act, 1988 but the remaining bills can be claimed along other head like menatl agony and physical pain , loss of income and loss of future income, etc.
