felony of insurance company

My bike accidents while driving my bike a 4 cm dent is occured on left side of petrol tank. Insurance company Suryeior is saying we will give you same petrol tant after dent paint.We will collect tank from your house and delivered after dent paint.But due to my new bike I want new petrol tank from insurance company.How do I fight against felony of Insurance company and How I take new petrol tank from insurance company?Is insurance company,s version of dent paint is true?

You may need to read terms of your policy carefully; if your demand for a new tank is covered as per your entitlement, you may pursue your remedy before a consumer court.

The normal rule is that the company may not replace those parts which may be repaired and restored to original position.

You may consider buying peace by accepting company's proposal. The litigation may be costly and time consuming.
