Legal Question in Insurance Law in India

insurance claim by appointee

i am an house wife, aged 52 years and my son had an insurance policy for which his minor son was the nominee and i'm the appointee. i received the insurance amount. my daughter-in-law left me after my son expired even after we requested her to stay with us and she is going to court demanding that the entire money should go her. she is still 22 and i am not sure that she will not marry and also she will not keep anything for my grandson. also i am with my husband, aged 62 years who earns a pension of just rs.600 per month. my daughter is with her husband in another city. I want to hand over the amount only after my grandson attains the age of 18 yrs so that he can use it for his life.

is it possible for my daughter-in-law to take legal actions against me

as long as you have been appointed as and appointee as per the documents of the insurance company, you need not to worry. whenever she goes to court you need to furnish the records in court and she wont be able to withdraw your money. But, make sure your name has been mentioned as appointee in insurance policy as well as in the records of the insurer company.

Re: insurance claim by appointee

Firstly I would like to make it clear that you are entitled to have equal share in the insurance money and other property/money left by your son.You can invest your share in the name of your grand son.your daughter-in law alone is not entitled to all money. In reply to rest it is advisable that you file a case for appointment of guardian of your grand son and then you will have the right to look after the welfare of your grand son.Yes your daughter-in law can file the case to claim the insurance money but you have to resist the same.
