change owership of house without house paper

my house father name and my father & mother are died. we are five brother and the eldest brother has taken the house paper and is not giveing it. can i traffer the house--name removed--every ones name with out the orginal house paper if yes how ? . if he has kepth the house paper at bank for loan , when what to do ? should file case on bank or my brother ?

You should approach civil cour and can seek declaration in respect of your father's property and can also approach Corporation for mutation.You can obtain certified copies of property from registrar if the property was purchased by your father.
