Not being paid for work got done online

I was alloted work relating to answering and type setting math problems.

There was a problem with regard to the format in which the allottee wanted the work typeset.

I participated along with the technical person relating to the organisation alloting me the work in trials to solve the problem.

I was required to work on an emergency basis on the work as required by them.

Suddenly the company stopped responding.

I need a redress.

I have the e-mail communication with the company as the proof. The company is supposed to have offices at 3 locations world wide.

I contacted the company when I found an advertisement for people who can do math in a newspapers job web site.

Your question is actually a Contract Question.

Do you have any contracts with the company that gave you the work or emails that will prove that the company gave you work and you both had an undestanding about the fee to be paid to you.

Most overseas companies do not pay until the project is done to their satisfaction. This is like giving credit online to an unknown entity.

The associated risks follow.

The following points are not clear from your message.

1. Did you have an understanding of the amount of time/effort you are needed to take and the type of solution to be given by you.

2. Did you have an understanding that irrespective of the outcome of your efforts you will be paid for time spent on the project by you?

3. Did you complete the project and arrive at the required solution?

4. Do you have a contract that specifies the jurisdiction and the dispute resolution forum?

5. Do you know if the person who asked you to do this work is authorized by the company to do so.

Dear mr. Natarajan

First of all you are required to put your house in order.

First of all list out the entire work done by you, thereafter take out the hard copy of the work order for the work assigned to you so as to have a proof of having assigned to you some work. Simultaneously you find out the addresses and all data of that company that pertains to its communication address.

After getting all the above details, get in touch with your lawyer and instruct him to issue a notice of demand of outstandings as per law prevailing in your area including demand of interest on outstanding sum.

In case the notice does not works than please go ahead with filing of money recovery suit and also criminal action for committing criminal breach of trust, fraud and cheating as per your lawyer's advice.
