Legal Question in Intellectual Property in India
Can I sell my flat without the N.O.C. from the society ?? Due to personnel reasons I am not in good terms with the society secretry & chairman & other managing commitee members. Is N.O.C. compulsory for the sale to take place ?? Is the society required to update their records & recognise the new buyer & include his name in its register of share holders & in the share certificate after I have sold my flat to him ??

Usually the society cannot prevent a owner from selling his property. The bye laws will have to be seen to know what action can be taken for refusal to issue NOC to you.
