Who can file the suit under Sec.29 of Trade & Merchandise Marks Act, 1958.

the person whose trade mark has been infringed only he can file the case.

Any person who has got a regd.trade mark and if he comes to know that his trade mark has been infringed by some boody, can oppose by filing his case before the Registrar of Trade Marks of the concerned Registry. Similarly if he comes to know that any trade marks registration application has been made deceptively similar to his regd.trade mark, he can raise his objection before the Registrar thro' a legal attorney or a regd.trade marks agent.
